The Supreme Court begins its new term on Monday, and the welcome back is not universal. “The Supreme Court’s term begins amid questions about its legitimacy,” reads a headline above a Washington Post news article. We could cite a dozen similar takes.

These articles offer no explanation for this anger, other than that the authors and the people who cite them do not like the opinions that the Court has issued in the last term. We know how you feel. For decades we disagreed with court rulings when progressives ruled, but we never called the court illegitimate. But now that the left has lost the court as a surrogate legislature for its political goals, the institution is said to be broken. Tell us again, who is the threat to democratic institutions?
