Jan. 6 Rioter Says He Didn’t know Congress Met in the Capitol

A Jan. 6 rioter who claimed he didn’t know Congress conducted its business in the US Capitol, despite describing himself as a history buff, was found guilty on all five charges against him on Friday, NBC News reported. One of those charges was a felony for obstructing an official process.

Timothy Hale-Cusanelli admitted that he entered the Capitol that day as he posted videos of himself inside the building on social media. But, he argued in court, he was unaware that members of Congress were meeting at the time. “I didn’t know the Capitol was the same as the Congress building,” he told a prosecutor.

“I know this sounds silly, but I’m from New Jersey,” he told jurors Thursday. “I feel like an idiot, it sounds idiotic and it is,” he added.

Hale-Cusanelli had been jailed since February 2021, in part because prosecutors presented Judge Trevor McFadden with substantial evidence of his past racist remarks. According to prosecutors, 34 of his colleagues interviewed by Naval Intelligence said he held “extremist or radical views regarding the Jewish people, minorities and women.”

Hale-Cusanelli, who was in the U.S. Army Reserve on Jan. 6 and was administratively discharged after his arrest, once said that “Hitler should have finished the job,” a Navy corporal recalled, according to court documents. The jury was not exposed to the full extent of Hale-Cusanelli’s racist comments or the images extracted from his phone. But they were shown a text in which he wrote that the Democrats would steal the 2020 election through “n****r manipulation.”

Hale-Cusanelli is due to be sentenced in September.
