Kanye West won’t face charges in punching incident

Kanye West, aka Ye, can rest easy after the Los Angeles Attorney announced on Tuesday that he was unjustly charged with allegations that he punched a man outside a downtown nightclub.

“Our office declines to file a case because there is not a reasonable likelihood of a conviction,” said Rob Wilcox, a spokesman for Los Angeles City Atty. Mike Feuer said in a statement to The Times. The decision was made after the city attorney general reviewed the Jan. 13 incident, he added.

According to Los Angeles Police Department investigating the altercation, the artist was accused of pushing and punching a fan around 3 a.m. near the members-only Soho Warehouse. West was having a verbal exchange with a person trying to get his autograph when the encounter escalated; He has since said the man is not a fan.

Michael A. Goldstein, West’s attorney, said the rapper appreciated the diligent review by the prosecution.

“My client has made every effort to mercifully disengage from an autograph agent whose stalking-like pursuit has crossed the line of acceptable behavior. The decision not to file criminal charges recognizes that my client did nothing wrong,” Goldstein said.

Video obtained by TMZ shows West yelling and gesturing near an SUV on the sidewalk.

“Did you say that or not? Did you say that or not? Because that’s what happened now,” he can be heard saying.

He had left the area when officers arrived at the scene and the alleged victim refused medical treatment, sources said.

The incident was viewed as a misdemeanor battery, carrying a maximum penalty of six months in prison, authorities said. Such offenses in the City of Los Angeles are reviewed by the City Attorney’s Office, not the District Attorney.
