L.A. federal prison guard sentenced after lying about sex with inmate

A former correctional officer at a federal penitentiary in downtown Los Angeles was sentenced this week to three months in prison for lying to investigators about sexual activity he engaged in with an inmate under his supervision, prosecutors said.

Abel Concho, 54, pleaded guilty to one count of misrepresentation last year.

During a July 2021 interview with federal investigators, Concho said he never had sexual contact with the inmate at the Metropolitan Detention Center, according to the U.S. Attorney for the Central District of California.

“After Concho initially denied having had any sexual contact with the victim, he then falsely stated that he only had sexual intercourse with the victim ‘once (or) twice’ that he could remember,” prosecutors said Monday in a press release.

According to US Attorneys, Concho had sexual contact with the inmate about 35 times.

In his plea agreement, prosecutors said, Concho admitted he knew sex between a prison officer and an inmate cannot be considered consensual under federal law and the Code of Conduct for Associates.

“After abusing his power to enter the halls of a federal facility to commit sexual abuse and then lying to cover up those gross abuses, the justice system is requesting that the defendant should now be spending time on the other side of the bars ‘ prosecutors wrote in a verdict memorandum.

Concho also falsely denied that he had provided the inmate with a cell phone to take nude photos.

“In fact, he illegally smuggled a cellphone into MDC and gave the cellphone to the victim to have it take nude photos for him, which the victim then did,” prosecutors said.

As part of the plea agreement, Concho is barred from seeking a law enforcement job or any job that requires a firearm.

In addition to the three-month prison sentence, Concho faces three months of house arrest and must pay the victim $9,500 in damages.
