A lawyer for the Duke of Sussex argued in court on Thursday that the royal household should not have been implicated in a British government decision to deny him police protection in the UK. Prince Harry’s lawyer, Shaheed Fatima, said at a Supreme Court hearing that the Queen’s private secretary, Edward Young, was part of the organization that decided Harry should not receive the same level of protection after he quit had to be a working king.

Fatima said Harry was unaware at the time that members of the royal household were involved in the decision and that certain members shouldn’t have been. “He was completely unaware at the time that the royal household was involved. He was told it was an independent decision,” she said.

The decision was made in February 2020 by the Executive Committee for the Protection of Royalty and Public Figures RAVEC on behalf of the Ministry of the Interior. Harry’s lawyers said he was denied an opportunity to testify before the committee and his offer to pay for security was not forwarded to them before the decision was made. “It is questionable whether RAVEC could or could have made a different decision in a fair trial,” said his lawyers.

The Home Office legal team said Prince Harry’s request for a judicial review of the decision should be denied because the “tensions” between him and the royal household were irrelevant and it was his change of status to a non-working royal that led to the decision being taken RAVEC. “It is not required to provide permanent automatic protection,” said Home Office lawyer James Eadie.

State attorneys said in court filings that if Harry’s application were denied, they would recover all costs incurred. “The public sector should not have to bear the cost of conducting this lawsuit and a claim that should not have been made in the first place,” added the Interior Ministry.

The court said it wants to decide by the end of the month whether to grant a full judicial review of the decision to end protection for Harry.
