The Ambition of Michigan Abortion Rights

Some of our friends on the right say that Wednesday’s editorial on a possible Michigan abortion referendum was an understatement of its true ambitions. If voters agree in November, the proposed constitutional amendment will protect unrestricted abortion until the fetus is viable (about 24 weeks), similar to the line previously used Roe v. calf.

But look at the language, our correspondents say. After fetal viability, the proposed change would guarantee access to abortion if “a treating physician” determines it is “medically indicated to protect the life or physical or mental health of the pregnant person.” A red flag is the undefined “mental health” exception, which could be abused to justify abortions months after profitability for anyone in need.
