Former President Donald Trump has written on Truth Social that he believes he may be arrested on Tuesday, March 21, 2023, in the Manhattan Attorney’s long-running investigation into a payment to Stormy Daniels.
If Trump is actually arrested, it will raise a lot of questions. Below: Would Trump be handcuffed? Would the Secret Service allow a former President of the United States to wear handcuffs? Would his mugshot be taken?
Trump has declared his innocence on Truth Social and berated the Manhattan Attorney’s office, which is headed by an elected Democrat, Alvin Bragg.
Of course, no one knows if Trump will actually be arrested or what would happen for sure if he were; In fact, his lawyer and spokesman told CNN he based his arrest comments on press reports and had received no formal notification that he was being arrested.
That being said, there is some information that can be gleaned about the likely process if Trump is arrested. According to NBC News, Trump’s attorney, Joe Tacopina, told the network that NBC said the former president would follow “normal procedures” if asked to surrender to Manhattan DAs.

To broadcast, Fox News host John Roberts reportedAccording to an unnamed source, law enforcement held a meeting “to discuss logistics for some time over the next week, which would mean they face an indictment.”
He said they had gone ahead with the preparations “beyond security” and hinted that the Secret Service would take the lead on “what they will or will not allow.”
Roberts said that according to the source, this includes the “decision whether or not to handcuff the former president,” adding that the Secret Service, which protects all former presidents, would “call the shots” and escort Trump into the courtroom.
According to Roberts, the Secret Service will coordinate with the Manhattan Attorney’s Office, but “they will defer to the Secret Service.” The source said the “battle will be between” the Secret Service and Manhattan District Attorney Alvin Bragg over how and when Trump would be in the building.
The source believes the former president “still needs to be fingerprinted and processed like any other defendant,” according to Roberts.

Business Insider reports that if Trump is arrested, there will likely be “a mugshot, fingerprints and a mandatory cheek DNA swab.” And there will be a judge’s appearance and a plea of not guilty – probably, but not necessarily, in open court.”
According to Business Insider, an employee typically “presents himself at a designated time on an agreed date at the DA’s Lower Manhattan headquarters and is immediately placed in the custody of district attorney investigators.”
According to Business Insider, if he were any other defendant, Trump would be “handcuffed down a hallway of the courthouse and into the courtroom by prosecutorial investigators — while the press behind barricades roared and filmed.”
However, Business Insider reports that while it’s possible that an arrest by Trump could be handled this way, a source told the publication that it’s also possible Trump wouldn’t be arrested at all and instead received a criminal subpoena to convict to appear on his charges.
“It appeared in court and was then printed before or after. No handcuffs,” the source told Business Insider in this scenario. Another possibility, according to the publication, is that the indictment could be handled virtually.
Bill Pickle, a former Secret Service special agent, told Business Insider he doubted the Secret Service would allow Trump to be exposed to potential harm through a traditional “perp walk.”
Some Democrats have long wanted to see former President Donald Trump in handcuffs, but Trump’s spokesman says he’s “completely innocent.”

According to an excerpt aired on Fox News, MSNBC host Tiffany Cross said in August after Trump’s Florida home was searched for classified documents: “I think a lot of people want to see Donald Trump handcuffed like in a COPS episode and go outside. We want to see how they convict Donald Trump and we may not see that.”
Regarding the Stormy Daniels investigation, Fox News also reported on its website that Bragg’s office had requested a meeting with law enforcement ahead of a “possible charge against Trump.”
Trump spokesman Steven Cheung told Fox News, “President Donald J. Trump is completely innocent, he has done nothing wrong, and even the biggest, most radical left-wing Democrats are making that clear.”
According to Fox, he added, “From Russia, Russia, Russia to the Mueller Hoax to Impeachment Hoaxes 1 and 2 and even the illegal Mar-a-Lago raid, Democrats investigated and attacked President Trump before he was elected – and they failed every time.”
